At long last a sentence for the Bonelli’s Eagles (Hireaaetus fasciatus) confiscated from Stefan Gavrilov in 2010
On April 4th 2012 the District Court of Vidin gathered for the second session of the trail against Stefan Gavrilov for an attempt to smuggle two Bonelli’s Eagles at Vidin Border Point in March 2010.
At long last justice triumphed and the District Court of Vidin claimed the defendant guilty at first instance.

Brief history:

On March 27th 2010, customs officers of the Vidin Ferryboat Border Point prevented the export of two specimens of Bonelli’s Eagle (Hieraaetus fasciatus) – an extremely rare species for Bulgaria. The birds were being exported with forged documents. The species is protected by the Bulgarian Biodiversity Act, enlisted in Annex 2 of the CITES Convention and Annex A of Regulation EC 338/97, regulating the application of CITES within the European Union. An interesting fact is that the smuggler claimed to be a staff of Green Balkans.

Two years later it was proceeded with the case. Charges in line with article 278 of the Criminal code were raised against the defendant. Unfortunately, despite the obvious evidence, the Prosecutor’s Office did not raise charges in line with article 242 of the Criminal code for document forgery.

As we already informed you this is an emblematic case of extreme importance for Bulgaria. Illegal wildlife trade on a global scale ranks third following trade of drugs and weapons. The Rescue Centre at Green Balkans had to accommodate several birds accidentally lost or deliberately released in Sofia – a Golden Eagle (Aquila chrysaetos) in the area of the National Palace of Culture, a Peregrine Falcon (Falco peregrinus brookei), Eleonora’s Falcon (Falco eleonorae) and a Goshawk (Accipiter gentilis), in a waste container together with two other birds, already dead, found close to the home of the defendant. In another case, a Saker Falcon (Falco cherrug) was seen several times in the capital city but could not be trapped. All birds recovered were marked with forged rings, similar to those of the two confiscated Bonelli’s Eagles with forged documents and were trapped in the area where the defendant lives. Later, in July 2011, the 50-year-old man was retained after a police search in his apartment, which found an illegally kept non-fledged Peregrine Falcon of sub-species which is not found in Bulgaria - Falco peregrinus calidus, together with a number of evidence that the man has been involved with illegal trade for years. The search carried out on July 27th 2011 found forged export certificates and stamps of the MoEW and the Austrian Ministry of Agriculture, Forests and Environment. We consider all these of direct relation to the forged documents presented at the export of the two Bonelli’s Eagles, confiscated a year earlier.

We are hoping on an effective sentence issued by the Sofia Court of Appeal, where the initial sentence will most probably be appealed. We hope that this trail will once again show the world that crimes against wildlife in Bulgaria are persecuted and punished with the entire power of law.

" ...   - gr.S . , have a criminal record ,  divorced , PIN ********** guilty   in  that   on 3/27/2010 on a  checkpoint " ferryboat "-  Vidin retain a copy   of the European endangered   wild vertebrate animals  -  two eagles on the type of   Bonelli's eagle  / Hieraaetus fasciatus /,  without the necessary authorization   under  Article 48, Article 49 and Article 85  of the Law   on Biological Diversity and Regulation  № 8/12.12.2003 on  the terms and conditions for issuing   permits exceptions to the prohibitions   introduced by the Biological Diversity Act for animal and plant species in Annex № 3,  a species from Appendix  № 4 for all bird species beyond those of Annex  № 3 and Annex  № 4 and the use of selective gear means and methods of capture and killing of Annex  № 5 , issued under   article 51  of the Biodiversity Act, and therefore under  chl.278v, Paragraph 4 of the Penal Code   sentenced him to " imprisonment "  for a period of  two years and six months, under Article 66 of the Penal Code POSTPONED serving as a punishment for four years and to pay a fine in favor of State the amount of 3000 / three thousand / lev.
          CONDEMNS defendant S.G.G.,   with the resumption of the above identity    to submit an account   of the Supreme Judicial Council  the sum of .... lev,  representing expenses for expert witnesses, and on behalf of   the Regional Directorate of the Interior - see the amount  .... lev, representing the costs  of printing and technical expertise.
          The verdict can be appealed   and   protested within 15 days   from   today before the Sofia Court of Appeal.
